What the legal framework looks like
The Kansas Parentage Act governs parentage proceedings, but it does not establish a comprehensive set of gestational-surrogacy agreement requirements. Do not assume that procedures used in another state apply automatically in Kansas.
Parentage procedure
The availability, timing and form of a parentage order should be confirmed for the specific case with Kansas reproductive counsel. This page does not treat a pre-birth order or a particular birth-record result as automatic.
Agreement and compensation
The proposed agreement should address compensation and expenses, insurance, medical autonomy, legal costs, termination provisions and dispute procedures. Enforceability and treatment of those terms should be reviewed under current Kansas law.
What this means for a surrogate
Before signing an agreement or beginning treatment, use independent Kansas reproductive counsel to confirm jurisdiction, the parentage strategy and the legal treatment of the proposed agreement.
